Item 11: Franchisor’s Obligations
The Freakie Fries Franchise Association will be the vehicle upon which any obligations by the franchisor will be satisfied.
At this writing, providing and protecting the Freakie Fries trademark is the only obligation.
The monthly royalty payment is for your right to use Freakie Fries only and any expenses for protecting the trademark is a legal expense that will be borne by the Association. The trademark defense fund is for this and the cost per member should not be so prohibitive. This will be accounted in the Capital Assets of the Freakie Fries Franchise Association.
At this writing, I have applied for a federal registered trademark for Freakie Fries in both the franchise and clothing wear categories. It is still too soon to say for certain that these will be had. If it is found that we cannot use Freakie Fries, I have a good replacement.
Upon joining in as a Freakie Fries franchisee, and becoming a co-franchisor, then, along with the other co-franchisors who are all experienced restaurant/spa persons, can begin to formulate the advertising program, the training program, and any other program deemed necessary for the efficient operation of Freakie Fries.
With the start of an advertising budget, the obligation to spend that budget for the best exposure is evident. The advertising monies that are collected will be put in a special account and as soon as there is the required amount, be spent on advertising. With advertising, we spend it as we make it. There’s no holding back with this. Advertising is the lifeblood of Freakie Fries!
Likewise, the training budget needs to be just enough to get results but not so much as to break the restaurateurs budget just as he/she’s trying to get off the ground. We don’t have to be perfect just as long as we are getting there!
It will be an obligation of Freakie Fries to provide guidance and support, both beginning and ongoing, especially to the new and not so experienced franchisees. This will be down the road because for right now, only very experienced restaurant persons will be recruited. These types that I am seeking can run a restaurant with their eyes closed and their hands tied behind their backs. In other words, absolute pros. At this stage, they’d probably be able to train me a thing or two.
It may be decided by the Association, that training be done by the nearest co-franchisee for a set fee as laid out by the Association either at the new location itself, or at a nearby already-in-operation location, or a little of both.
The fees being paid directly to the co-franchisor who is doing the training.
I reserve the right to open my own Freakie Fries restaurant/s and become a franchisee/co-franchisor along with the rest of the motley crew, as well as carry on my duties as the founder.
Franchisor obligations are subject to change as needed to run a successful franchise. The Freakie Fries Franchise Association will be the vehicle for this change through majority vote.
